The Upper Seat LLC · Effective September 9, 2026
This policy explains what The Upper Seat LLC ("The Upper Seat", "we", "us") collects when you use the Upper Seat iOS app, our website at theupperseat.nyc, our online booking, and our text message program, how we use it, and the choices you have. We built all of it to deliver a personal grooming experience - we collect only what we need to do that well, and we do not sell your data.
We do not use your data for cross-app or cross-site advertising, and we do not track you across other companies' apps or websites.
We share data only with service providers that help us run the app, each under a data-processing agreement. They process data on our behalf, not for their own marketing. The mobile information and messaging consent restrictions below apply to all providers:
We may also disclose information if required by law. We do not sell personal information.
We collect a mobile phone number when you create an account or book a visit. We use it to send appointment reminders and updates about a visit you have booked, and to verify your account with a one-time code. Agreeing to receive text messages is never a condition of booking or of any purchase.
With your separate, optional consent, we also use your number for The Upper Seat promotions and shop announcements. Up to one campaign per day, plus an enrollment confirmation and replies to your STOP, START or HELP requests. Appointment message frequency varies with bookings. Message and data rates may apply. We record the number, channel, disclosure, time and source of your consent. Consent is not a condition of purchase.
We never sell, rent or share mobile phone numbers, SMS opt-in records or messaging consent with third parties or affiliates for their marketing or promotional purposes. We use service providers, including Twilio, to deliver messages and provide support on our behalf. They may process only the information needed for those services and may not use it for their own marketing. Messaging consent is not transferred to another business or used to enroll you in another business’s messaging program.
Reply STOP to the sending number to stop that program. Campaign texts and appointment texts use separate numbers and separate consent. You can turn off campaigns in campaign preferences, and appointment reminders in the app. Stopping either program does not cancel your appointment. What we send, how often, and how to get help are set out in our SMS Terms, and the wording you agree to is shown on our SMS Opt-In page.
Your barber sees only what they need to serve you — your name, grooming and seat preferences, style notes, and service history. Your barber does not see your phone number or email address.
We keep your account data while your account is active and for up to 12 months after closure so we can honor refunds and resolve disputes. You can request earlier deletion (see below).
We protect your data with encryption in transit (HTTPS/TLS) and at rest, and we limit access to the people and services that need it. No system is perfectly secure, but we work to keep yours safe.
The Upper Seat is not directed to children under 13, and we do not knowingly collect personal information from them.
We may update this policy. Material changes will be surfaced in the app before they take effect, and the effective date above will be updated.
