SMS Terms

The Upper Seat LLC · Effective September 9, 2026

These terms cover the text messages sent by The Upper Seat. The program is operated by The Upper Seat LLC, with its registered office at 2150 N Bayshore Drive, Miami, Florida 33137, United States.

Appointment texts

The Upper Seat sends appointment reminders and updates about a visit you have booked - a confirmation, a reminder before the visit, and a message if the time, the barber or anything else about that visit changes. Every message is tied to an appointment you made.

The appointment program does not send marketing or promotional texts.

Campaign texts: promotions and shop announcements

A separate, optional campaign program sends The Upper Seat promotions and shop announcements from its own number, only after you explicitly select SMS campaigns. Up to one campaign per day, between 9am and 8pm New York time. Consent is not required to book or buy. Message and data rates may apply. Reply STOP to stop campaign texts or HELP for help; stopping campaigns does not stop appointment texts from the separate appointment number.

Manage campaign permissions in campaign preferences. After replying STOP, reply START to the campaign number and then opt in again through preferences. A barber cannot provide this permission for you.

How often each program texts

Appointment messages are sent per appointment, so message frequency varies with how often you book. A single booked visit is usually a confirmation and one or two reminders, plus a message if something about that visit changes.

Campaign texts are recurring: up to one promotion or shop announcement per day, between 9am and 8pm New York time. We also send an immediate enrollment confirmation when you opt in, and replies when you send STOP, START or HELP. These confirmations are separate from the daily campaign limit.

The enrollment confirmation reads: "The Upper Seat: You are subscribed to promotions and shop announcements. Up to 1 campaign/day. Message and data rates may apply. Reply HELP for help or email hello@theupperseat.nyc. Reply STOP to unsubscribe."

Cost

Message and data rates may apply. The Upper Seat does not charge you for these messages; your mobile carrier may charge you for sending or receiving them under your own plan.

Consent is optional

Consent to receive text messages is not a condition of booking a visit or of any purchase. You can book, pay and hold a membership without ever agreeing to be texted. How and where consent is given is shown on our SMS Opt-In page.

Stopping the messages

Reply STOP to a campaign text to cancel campaign texts. We send one confirmation message telling you that you have been unsubscribed, and after that we stop texting that number through the campaign program. Appointment texts from the separate appointment number are unchanged. You can also turn campaign texts off in campaign preferences.

After stopping campaign texts, reply START to the campaign number to remove the carrier block, then explicitly select Campaign texts and save in campaign preferences. START alone does not subscribe you to campaigns. To stop appointment texts, reply STOP to the appointment number or turn text reminders off in the app. Reply START to the appointment number to remove its carrier block and enable appointment reminders in the app or booking form. Stopping either program does not cancel your appointment.

Getting help
